Since 2023, Bay Area cities have been processing an unprecedented number of Builder’s Remedy project applications that were submitted when those cities’ Housing Elements were out of compliance. These applications represent thousands of housing units that must be approved for housing development projects that include a minimum amount of affordable housing, unless an agency can make narrow findings for denial.
Join ULI SF to hear an update on the projects that have been approved and the issues that others are working through. We’ll also cover the implications of new legislation adopted in 2024 to both place guardrails on the use of the Builder’s Remedy entitlement pathway and facilitate projects that are eligible under the new law.
Speakers:
- Chris Elmendorf, Professor of Law at UC Davis
- Edith Ramirez, Assistant City Manager for Development Services at City of Morgan Hill
- Chelsea Maclean, Holland & Knight LLP (moderator)
